Decatur: Appeals Court Overturns Kelly Nichols' Child Pornography Conviction After 6-Year Sentence

An Illinois appellate court overturned the child pornography conviction of Decatur mother Kelly Nichols, ruling the images of her daughters did not meet the legal definition of child pornography under state law. Nichols had been serving a six-year sentence.

A ruling that changes everything

An Illinois appellate court overturned the child pornography conviction of Kelly Nichols, a Decatur mother who had already served years of a six-year prison sentence. The Fifth District Appellate Court issued its 30-page ruling on Tuesday, reversing and dismissing all charges against the 55-year-old.

The court found that the photos and videos used as evidence in her case did not meet the legal definition of child pornography under Illinois law.

The six-factor test

The appellate court applied a six-factor test to determine whether images qualify as child pornography under state statute. The factors include:

  • Whether the focal point of the image is on the child's genitals
  • Whether the setting is sexually suggestive
  • Whether the child is depicted in an unnatural pose or in inappropriate attire
  • Whether the child is fully clothed, partially clothed, or nude
  • Whether the image suggests a willingness to engage in sexual activity
  • Whether the image is designed to elicit a sexual response from the viewer

The court concluded that while the images "were deplorable, they are not lewd nor do they constitute child pornography as defined by Illinois statute," according to the ruling reported by WANDTV.

A conviction built on family photos

Nichols was found guilty in October 2024 on 10 counts of possession of child pornography and one count of manufacturing child pornography in Macon County Court. The images at issue were of her own daughters.

Her attorney, Mike Leonard, called the original conviction a gross mistake and said the case should never have reached a judge.

"The judge made a gross mistake finding Kelly guilty. She got a six-year sentence. She's been in prison serving that sentence, so even though victory is extremely sweet, it's hard-earned and never should have happened in the first place," Leonard told NewsChannel 20.

Leonard added that anyone who knows Nichols understood the conviction was "absurd" and caused significant damage to her reputation.

What happens next

The appellate court ordered that Nichols be discharged from her sentence. Her conviction has been fully reversed and dismissed.

Nichols' husband, Doug Nichols, was also convicted of possessing child pornography and sentenced to three years in prison with two years of conditional discharge. He faces separate charges of criminal sexual assault of a minor and aggravated criminal sexual abuse of a minor. Doug Nichols is scheduled for a change of venue hearing on June 30.

Leonard said attorneys representing Doug plan to ask the appellate court to apply the same logic and drop his charges as well. His appeal is a few months behind Kelly's because his sentencing occurred later.

"Everyone from the Nichols' family, supporters and those within the greater Decatur community is ecstatic. It's been like a horrible movie for a beloved community member. It's been years of frustration and utter disbelief that she was ever charged and accused of this. These were routine photos, and everyone is in disbelief that she was caught up in this," Leonard said in a statement to WANDTV.

WANDTV reported that the outlet reached out to the Macon County State's Attorney's Office and to attorneys representing Kelly Nichols for additional comment.

NewsChannel 20 reached out to Michael Havera of the State's Attorneys Appellate Prosecutor's Office but did not receive a response at press time.
